Two Italian marines accused of killing two Indian fishermen in February 2012 are entitled to immunity from prosecution in India, a court has ruled. Salvatore Girone and Massimiliano Lattore were guarding an Indian oil tanker off the Indian coast and say they mistook the fisherman for pirates. Italy has argued that the marines fired on a boat carrying the two Indian fishermen after they failed to heed warnings to stay away from the MV Enrica Lexie tanker off the coast of the south-western state of Kerala. Meanwhile, India charged the marines with murder, arguing that is has jurisdiction. Rome has insisted the shooting took place on international waters and therefore the men should be tried in Italy. The high-profile case has strained relations between Rome and Delhi. Judges at the Hague-based Permanent Court of Arbitration (PCA) – the court that deals with disputes between countries and private parties - ruled that the marines should be immune from prosecution in India but should face trial in Italy. The two marines were held in custody for several years in India before being allowed to return to Italy.

I giudici della Corte di Arbitrato Permanente, che controllano i conflitti tra paesi differenti, dicono che i marinai dovrebbero essere giudicati in italia. I due marinai ebbero diversi incarichi per parecchi anni in India prima che gli fu permesso di ritornare in italia.
